"THIS" (a) is why Article I courts are the Republic's common law Courts: 28 USC § 1651. Writs (a) The Supreme Court and all courts established by Act of Congress may issue all writs necessary or appropriate in aid of their respective jurisdictions and agreeable to the usages and principles of law. (b) An alternative writ or rule nisi may be issued by a justice or judge of a court which has jurisdiction. And (b) is "statutory authority" for any court claiming jurisdiction to issue (on Petition) a single judge 'alternative writ" such as Writ of Praecipe that combines the command of a Writ of Mandamus to give requested relief, with the option of showing cause why such relief is not justified. The respondent can then decide to give relief or attend a 3 judge hearing, and if the Petitioner wins the hearing the 3 judge court will issue a final mandamus ordering the relief.
