The UCMJ "created" 2 levels of appeals courts to review Court Martials, both of which have jurisdiction to accept petitions for 'All Writs'.. ( WRIT, practice. A mandatory precept issued by the authority, and in the name of the sovereign or the state, for the purpose of compelling the defendant to do something therein mentioned.) The courts of common law in England required the injured party to obtain an Original writ under the Great Seal from the Court of Chancery as Step 1 in prosecuting their claim.. A Praecipe is a form of Original Writ that allows the respondent to cure the injustice within x- days or appear in court... making it an administrative form of relief as it will not require any Trial.. So within x-days you could have your relief.. without any judicial proceeding... All that is required to make use of this process is the acknowledgment that the petitioner is subject to the UCMJ .. (the next piece of the puzzle)
