In 2019 Trump signed into law "The Legion Act". In so doing both the Legislative and Executive Branch agreed that the United States has been at war since December 7, 1941.
This being the case, every enlistee is to this day a member of the Armed Forces of the United States, most in a status other than Active Duty, but none the less members who are subject to the UCMJ, and entitled to pay, allowances and other benefits.
This includes retirement pay after age 60. Proof that this retirement pay is being paid (even if uncollected) is the "Military Retirement Fund Audit" which shows that 1.6 TRILLION dollars of paid retirement has been deposited into the fund (instead of collected by the retiree).

But first things first, and that is that The American Legion must register an agent in every state as the Legion's congressional charter requires. When this is done The American Legion will be the United States, and as it's members are the only persons in federal service to execute a proper oath of office will it become the Civil Authority of the Armed Forces of the United States. So please help make sure the Legion does what the charter requires.
